These Terms of Service ("Terms") govern your access to and use of Viral Machine ("viralmachine.ai", the "Service"). By using the Service, you agree to these Terms.
1. Eligibility and Accounts
- You must be legally able to enter a binding agreement to use the Service.
- You are responsible for keeping your account credentials secure.
- You are responsible for activity on your account and for content published using your connected channels.
2. Service Description
Viral Machine provides tools for AI-assisted video creation, scheduling, and optional social platform publishing integrations.
The Service is provided as software for content production workflows. It is not a managed marketing agency service, legal/financial/medical advisory service, or an engagement manipulation service.
Social publishing features depend on third-party platforms and APIs and may change or be unavailable based on those third parties.
3. YouTube and Third-Party Platform Terms
If you connect or use YouTube through Viral Machine, you agree to be bound by the YouTube Terms of Service.
Your use of other connected platforms (such as TikTok and Instagram) must also comply with their applicable terms and policies.
4. Subscription, Billing, and Trials
- Paid features may require an active subscription.
- Unless stated otherwise, subscriptions renew until canceled.
- You authorize applicable charges and are responsible for taxes and fees required by law.
- Billing is handled by third-party payment processors. We do not store full payment card numbers.
- Refund requests are reviewed under our Refund Policy.
5. User Content and Licenses
- You retain ownership of content you upload or create using the Service.
- You grant us a limited license to host, process, and transmit your content solely to operate and improve the Service.
- You represent that you have all rights needed to upload, generate, and publish your content.
- You are responsible for obtaining any required consents, permissions, and disclosures related to synthetic or AI-generated media you create or publish.
6. Acceptable Use
You agree not to use the Service to:
- Violate law or third-party rights.
- Upload malware, attempt unauthorized access, or disrupt the Service.
- Infringe intellectual property or privacy rights.
- Abuse APIs, automation systems, or rate limits.
- Create or distribute deceptive or harmful synthetic media, including impersonation, non-consensual deepfake content, fraud, or identity misrepresentation.
- Create or distribute content that is illegal, sexually exploitative, abusive, hateful, or otherwise prohibited by applicable law.
- Use connected social platform features for spam, fake engagement, or behavior that violates platform rules.
- Circumvent safeguards, access controls, or technical restrictions intended to protect the Service or third parties.
You are responsible for ensuring content and publishing behavior also comply with third-party platform policies, including YouTube, TikTok, and Instagram requirements.
7. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create security risk, or if required by law. You may stop using the Service at any time.
We may also remove content, disable publishing integrations, or limit account functionality while investigating suspected violations.
8. Intellectual Property
Except for your content, the Service, including software, branding, and related materials, is owned by Viral Machine or its licensors and protected by applicable law.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Viral Machine and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.
Our total liability for claims related to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim arose.
11. Indemnification
You agree to indemnify and hold harmless Viral Machine and its affiliates from claims, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted with a revised "Last updated" date.
